Under House Bill 3536, which was enacted during the 83rd Regular Legislative Session and took effect September 1, 2013, all non-settling manufacturers which were not offering cigarettes or cigarette tobacco products for sale or distribution in Texas on September 1, 2013, and which want to offer cigarettes or cigarette tobacco products for sale or distribution in Texas must provide certain information to the Attorney General before the manufacturer begins doing so. The form for this Non-Settling Manufacturer Report can be downloaded from this page. Please see Texas Health & Safety Code section 161.602 for definitions of terms used in the Report.

Note: the information reported to the Attorney General will be made available to the Comptroller of Public Accounts and does not take the place of any reporting or other obligations required by the Comptroller of Public Accounts. This includes, but is not limited to, the procedures necessary to be treated as a Subsequent Participating Manufacturer under Texas Health & Safety Code section 161.602(14).
