On January 10, 2008, a Bexar County State District Court approved the State’s proposed plan to distribute restitution funds in this case. The Court approved Randolph Osherow as the Disbursing Agent – the person responsible for issuing and distributing the corresponding checks.
The first round of checks will be sent to consumers whose information could be confirmed by the Office of the Attorney General when comparing it against BioPerformance records, including amounts paid in, consumer addresses, etc. Those checks will be issued beginning in mid-January through mid-February, 2008.
A second round of checks will be sent later in 2008 to consumers whose information is still in the process of verification.

Once the Disbursing Agent obtains the funds deposited into an escrow account, it is estimated it will take 10 days to issue a check by mail.
If your information has been confirmed, you will be getting a refund of your initial payment and product purchase cost.
The court approved payment of the product costs only - commissions will not be refunded.
You may wish to contact the people who ran BioPerformance. The Attorney General’s settlement does not limit your right to seek further relief against BioPerformance.
You will be getting a full payment for the refund for product purchase and initial payment to join BioPerformance, without interest.
The Office of the Attorney General cannot guarantee that late filed claims will be able to be confirmed and paid before the refund process is complete, but you may file a claim by following the directions for filing a complaint by going here.
