Three evaders arrested within past week

AUSTIN - Texas Attorney General John Cornyn today announced the arrest of Child Support Evader Marcus Glen Smith of Seguin, Texas, who owes $26,167 in child support for his daughter in Nacogdoches. Smith's case is the third to be resolved since the Attorney General announced his most recent list of the 10 most-wanted Evaders on January 31, 2001. The State's most-wanted Evader, Ollie Lynn Little, was arrested in De Leon (Comanche County), Texas on Sunday. Little owes $131,848 for his son in Midland. Henry Lee Towers, Jr. was arrested Friday in Fairborn, Ohio, and owes $26,939 for his son in Paris, Texas.

"I want to thank the public and members of the law enforcement community for helping us locate three of the worst Child Support Evaders in Texas. We will continue working with law enforcement officials to notify dead beat parents that we are committed to finding them and to making them live up to their responsibilities, or suffer the consequences," Attorney General Cornyn said.

Smith was arrested near Seguin by a deputy from the Guadalupe County sheriff's office. During a routine traffic stop, the deputy checked Smith for outstanding warrants and discovered that Smith was wanted on a warrant for failing to pay child support.

On January 31, Attorney General Cornyn announced that Smith had been placed on the top 10 most wanted list of Texas Child Support Evaders and asked the public and law enforcement to help locate and arrest Smith.

Smith is currently being held without bond in the Guadalupe County Jail and will be returned to Nacogdoches to face the pending charges. Smith faces up to six months in jail and payment of all unpaid support.

For a noncustodial parent to be placed on the Evader page, there must be a court-ordered obligation with delinquent support in excess of $5,000 and an arrest warrant issued. The location of parent must be unknown and the parent has not made any payments in the last 6 months. The parent must not be involved in bankruptcy proceedings or receiving welfare benefits. To make information public, the custodial parent must sign a confidentiality waiver and supply a picture of the delinquent parent.
