RE: Bond Counsel Input on Issues Raised by the Texas Education Agency

Attached is a copy of an August 17, 2009 letter from Robert Scott, Commissioner of Education, seeking guidance about the ability of a school district to make payments on its bonds from certain specified funds other than a debt service ad valorem tax. The Public Finance Division will be responding to this request in the form of an All Bond Counsel letter. We are informing you of this request to give you an opportunity to submit legal briefs in response to these questions if you wish to do so.

We ask that briefs be submitted by October 15, 2009 to give us adequate time to review and consider arguments relevant to this request. To ensure we have time to consider all arguments and do additional research as needed, our response should not be expected prior to January 2010. Please note that briefs and other correspondence are subject to the Public Information Act.
