Dear Mr. Hines:
You have asked whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID# 123256.
The Office of the Governor (the "governor") received a request for information concerning a particular case.(1) You assert that sections 552.107 and 552.111 are applicable to protect the submitted records from disclosure. Section 552.107(1) protects from disclosure information that reveals client confidences to an attorney or that reveals the attorney's legal advice, opinion, and recommendation. See Open Records Decision No. 574 (1990). Section 552.111 excepts interagency and intraagency communications from disclosure only to the extent that they contain advice, opinion, or recommendation for use in the governmental body's policymaking process. Open Records Decision No. 615 at 5 (1993). We have reviewed the records at issue and marked the portions that are protected from disclosure under section 552.107. The unmarked portions of the documents submitted are not protected from disclosure under either section 552.107 or 552.111 and must be released.
We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records.
