Dear Mr. Corzine:

You have asked whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID# 125727.

The Ector County Independent School District (the "district") received a request for minutes of certain closed sessions of the meetings of the board of trustees and also for the tape recordings of certain board meetings. You assert that the only documents at issue are the certified agendas and the tapes of executive sessions of the district's board of trustees. Certified agendas and the official tape recordings of closed, executive session meetings are confidential and available only under a court order. Gov't Code 551.104. The information at issue thus is confidential and may not be released. Gov't Code 552.101; Open Records Decision No. 563 at 6 (1990).

We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records.
