Dear Ms. Pierce:
You ask whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID# 129135.
The Austin Independent School District (the "district"), which you represent, received an open records request from Michelle Kurtz of the Austin American- Statesman requesting the following:
1 - All future correspondence between the AISD Administration and the school board.
2 - All future correspondence sent from any school board member to other trustees.
Ms. Kurtz requested that this information be copied and made available at the time it is sent to board members. It is well established that a governmental body need not comply with a standing request to provide information "on a periodic basis" Open Records Decision No. 465 (1987); or on a weekly basis, Open Records Decision No. 476 (1987); or to treat a request as embracing information prepared after the request was made, or to inform the requestor subsequently when the information does come into existence. We agree that Ms. Kurtz's request constitutes a standing request for information not yet in existence. Therefore, the district need not comply with this request.
We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records.
