Mr. James Corley Henderson
Dear Mr. Henderson:
On behalf of the City of Paris (the "city"), you seek assistance in complying with Open Records Letter No. 99-2360 (1999). Specifically, you ask that we provide you with directions as to how to redact the private portions of information that were requested from the city under the Public Information Act, chapter 552 of the Government Code. Your request was assigned ID# 129476.
In Open Records Letter No. 99-2360 (1999), this office determined that the city must release to the requestor requested information concerning its former city attorney, but that portions of the requested information were protected from required public disclosure pursuant to section 552.101 of the Government Code in conjunction with the common-law right to privacy. See Industrial Found. v. Texas Indus. Accident Bd., 540 S.W.2d 668 (Tex. 1976), cert. denied, 430 U.S. 931 (1977); Morales v. Ellen, 840 S.W.2d 519 (Tex. App.--El Paso 1992, writ denied). You have submitted to this office copies of the requested information with redactions. We have reviewed your redactions, and, for the most part, agree with your markings. However, we disagree with you in regard to several of your redactions. We have indicated to you on the submitted records our points of disagreement. The city must release the records in accordance with our markings.
This ruling is limited to the particular records at issue under the facts presented to us in this request and may not be relied upon as a previous determination regarding any other records. If you have questions about this ruling, please contact our office.
