Dear Ms. Cary:

You have asked whether certain information is subject to required public disclosure under the Public Information Act (the "act"), chapter 552 of the Government Code. Your requests were assigned ID#s 129306 and 129437.

The Office of the Attorney General (the "OAG") received two related requests concerning OAG investigations of "open government" matters. The first request, specifically, asks for "ALL information in every form related to each of greytock's [sic] alleged 'investigations', 'verifications', 'supervisions', 'reports of compliance'" concerning specified Open Record Letters. The second request effectively seeks the same information. You submit to this office a memorandum and a representative sample of the requested information.(1) You seek to withhold a portion of the information responsive to the requests under sections 552.101, 552.103, 552.107, and 552.111 of the Government Code. We have considered your arguments and reviewed the submitted information.

At the outset, we note that the pending requests are related to an earlier open records request for information by the same requestor. See Open Records Letter No. 99-2664 (1999). In Open Records Letter No. 99-2664, the requestor requested a variety of information relating to the requestor's complaints to the OAG regarding public information matters, for which the OAG raised the same exceptions as those claimed for the pending requests. Furthermore, you represent that the submitted records are identical to those responsive to Open Records Letter No. 99-2664. Therefore, you may rely upon ORL 99-2664 (enclosed) concerning the records responsive to the pending requests, and release or withhold the information accordingly.

We are resolving this matter with an informal letter ruling rather than with a published open records decision. This ruling is limited to the particular records at issue under the facts presented to us in this request and should not be relied upon as a previous determination regarding any other records. If you have questions about this ruling, please contact our office.
