Dear Ms. Clark:

You ask whether certain information is subject to required public disclosure under chapter 552 of the Government Code. Your request was assigned ID# 142015.

The City of Houston (the "city") received a written request for records pertaining to an investigation of two employees of the city's Parks and Recreation Department. You state that the city has released some documents responsive to the request. You contend, however, that this office has previously determined that other responsive information is excepted from disclosure under section 552.108 of the Government Code.

We have reviewed the information that you seek to withhold and agree that the release of such information is governed by a previous ruling issued by this office, Open Records Letter No. 2000-3294 (2000). Consequently, we need not further address the applicability of section 552.108 to this information at this time. See Gov't Code 552.301(a). Furthermore, should the city receive subsequent requests for this exact same information in the future, the city may rely on those previous determinations as authority for withholding the information without having to request another decision from this office unless the facts or the law governing the information change. See Gov't Code 552.301.
