Mediation Advocacy

Even for litigators, many of their "trials" occur outside of the traditional courtroom. Most deals and lawsuits are privately negotiated, settled in mediation, or determined by arbitrators. Clients are best served when their lawyers are familiar with dispute resolution processes and can assess which one best fits their case. In this training, we will focus on the mediation process and skills for advocates in mediation. Effective advocates prepare their clients for mediation, understand how best to use the mediator, and contribute to the process to reach the best outcome for their clients. The training will use a mix of discussion of essential skills and exercises related to ethical challenges faced by advocates in mediation.

This program has been approved for 3.5 hours of MCLE credit, including .50 hour of ethics credit, by the State Bar of Texas' MCLE Department.

Cynthia Bryant is a clinical professor at The University of Texas School of Law.

Understanding Perjury

This course will focus on an attorney's ethical obligations and procedures to be followed when their client or witness commits perjury.  This presentation will also include discussion on the proper ethical course to take when an attorney is made aware in advance that their witness intends to lie on the stand.  The civil and criminal consequences of suborning perjury will also be discussed. 

This course has been approved for 1.0 hour of MCLE credit, including 1.0 ethics hours, by the State Bar of Texas' MCLE Department.
