This reporting is mandatory pursuant to Section 402.0352 of the Texas Government Code (updated and effective on September 1, 2025). If your State or Law Enforcement Agency resides in a county with a population of 50,000 or more and it is one of the following identified entities, the agency MUST submit investigation reports in accordance with Section 402.0352:

  • Municipal police departments
  • Sheriff’s departments
  • Constable’s offices
  • The Department of Public Safety
  • The Department of Family and Protective Services
  • The Texas Department of Licensing and Regulation
  • The Office of Court Administration of the Texas Judicial System
  • The Texas Department of Criminal Justice
  • The Texas Juvenile Justice Department
  • The Texas Alcohol and Beverage Commission

Section 402.0352 requires the above agencies in counties with a population of 50,000 or more to submit human trafficking data to the Office of the Attorney General (OAG) in the manner and form prescribed by the Attorney General. Reports are due every six months:  on April 1 and October 1.

This form MUST be submitted for EACH individual human trafficking investigation (mandatory-reporting offense).  A mandatory-reporting offense per Section 402.0352 is a Chapter 20A offense or a Chapter 21, 22, or 43 offense that may involve human trafficking.  For multiple suspects, same mandatory-reporting offense, and course of conduct, one submission is permissible (listing multiple suspects).  For multiple suspects, same course of conduct, but different mandatory-reporting offenses, separate submissions are required.  Please ensure that all fields on the form have been completed and provide an explanation for any fields that are not completed.

We encourage organizations to engage in internal discussions to determine the responsible party for these submissions to eliminate duplicative efforts and ensure continued compliance with the statute.

An agency that submits a report in accordance with Government Code Section 402.102 (applicable to only Penal Code Chapter 20A offenses) does not need to also submit the data on that investigation here.  Note this only applies for Chapter 20A investigations.  Data for Chapter 21, 22, and 43 offenses that may involve human trafficking must still be submitted using the webform below.

If your agency is one of the listed agencies above and it has no investigations to report, the agency still must submit a form biannually to remain in compliance. Please complete ALL required contact information and check the box for “NO OFFENSE TO REPORT” to ensure compliance.

If your agency is a county under 50,000 in population and chooses to report human trafficking investigations, please follow the same procedures listed above.

We encourage you to keep an internal copy of submissions for your records. If you have questions please review our Frequently Asked Questions about Human Trafficking Reporting or email us at [email protected].
