The U.S. Supreme Court today ruled for Texas in a death penalty case involving Erick Davila, a Fort Worth man who killed a 5-year-old and her grandmother at a children’s birthday party while attempting to shoot rival gang members.
The legal issue presented in this case concerned the finality of convictions when prisoners asserted claims of ineffective assistance of both state habeas and direct appellate counsel.
“With its decision on the Davila case, the U.S. Supreme Court honored the finality of duly entered convictions,” said Attorney General Ken Paxton. “Had the high court ruled otherwise, states and the federal court system would have been burdened with an avalanche of claims facing an infinitesimal chance of success.”
